Scope of Services:
1.1. Your Web specializes in designing and implementing websites based on the Wix platform.
1.2. Our services include website planning, design customization, content creation, development, integration of functionalities, and deployment of the website on the Wix platform.
Client Responsibilities:
2.1. The client is responsible for providing accurate and complete information necessary for the design and development process.
2.2. The client must provide timely feedback and approvals during the project timeline to ensure efficient progress.
2.3. The client is responsible for obtaining any necessary permissions or licenses for content used on the website, ensuring compliance with copyright and intellectual property laws.
Design and Development Process:
3.1. Your Web will collaborate with the client to understand their requirements, goals, and branding preferences.
3.2. Your Web will provide design concepts and mock-ups for client review and feedback.
3.3. Development and customization of the website will be carried out based on the approved design, including integration of requested features and functionalities.
3.4. Your Web and Client will conduct thorough testing to ensure the website functions as intended and is compatible across different devices and browsers.
3.5. The website will be deployed on the Wix platform and handed over to the client upon final payment.
Payment Terms:
4.1. A detailed proposal with the estimated project cost will be provided to the client.
4.2. Payment terms and milestones will be outlined in the proposal.
4.3. Your Web reserves the right to suspend work or withhold deliverables until payment obligations are fulfilled.
Intellectual Property:
5.1. All website designs, code, and customizations created by Your Web during the project will be delivered to the client upon completion and final payment.
5.2. Upon delivery, the client will hold the intellectual property rights to the website designs and customizations, and Your Web will not retain any ownership or rights unless otherwise agreed upon in writing.
5.3. Your Web may request permission to showcase the completed website as part of our portfolio or marketing materials, with the understanding that any proprietary or sensitive information will be kept confidential.
Confidentiality:
6.1. Your Web and the client agree to maintain the confidentiality of any proprietary or sensitive information shared during the project.
Limitation of Liability:
7.1. Your Web is not liable for any loss, damage, or costs arising from the client's use of the Wix platform or any third-party services integrated into the website.
7.2. Your Web is not responsible for any loss of data or security breaches on Wix Platform that may occur due to factors beyond our control.
Termination:
8.1. Either party may terminate the agreement with written notice if the other party fails to fulfill its obligations, subject to any applicable cancellation fees or costs incurred.
Governing Law and Jurisdiction:
9.1. These terms and conditions shall be governed by and interpreted in accordance with the laws of New Zealand and Australia.
